The atm of the research was to identify and analyze the factors contributing to the
ineffectiveness of criminal law as a means of social control in the fight against crime in
Peru; for which a qualitative, cross-sectional exploratory study was conducted with a nonexperimental
design was developed in the field of national jurisdiction, lacking temporal
and spatial delimitation problem by the type of research conducted. The sample consisted
of the analysis of the doctrine, jurisprudence and regulations. The signing and content
analysis were used as teclmiques, using data collection instruments tabs and tab content
analysis. Among the method we used to exegetical, henneneutical, legal argumentation.
Research has shown that there are legal factors - Regulations and judicial areas and
extralegal - media and social pressure that contribute to the inefficiency of criminallaw as a
means of social control in the fight against crime in Pcru, consequently mechanisms fight
ahead using criminallaw ineffective, showing the ineffectiveness in the increase in crime
and insecurity, thereby showing the failure of the criminallaw as a means of social control
ofcrime.
